Processing of (personal) data by the entity in charge of the online application process

Privacy Notice for Applicants

General

This privacy notice explains how LEASETEQ (LeaseTeq AG, or one of its subsidiaries) processes personal data in connection with your online application and recruitment process. It applies to applications submitted via our careers page, by email, or through other recruitment channels used for roles in Switzerland, Germany, and Austria. The applicable data protection laws are, in particular, the Swiss Federal Act on Data Protection (“FADP”) for Switzerland and the EU General Data Protection Regulation (“GDPR”) together with applicable national laws, including the German Federal Data Protection Act (“BDSG”) and the Austrian Data Protection Act (“DSG”), for Germany and Austria.

Categories of personal data

In the course of the application process, LEASETEQ may process the following personal data:

  • Identification and contact data, such as first name, last name, email address, telephone number, address, and LinkedIn profile where provided.
  • Application data, such as CV, cover letter, references, certificates, employment history, qualifications, language skills, salary expectations, availability, and correspondence.
  • Additional data that you voluntarily provide during the process.
  • Technical data collected when using the careers page, such as log data that may include IP address, browser information, device information, and access times, insofar as this is technically necessary to provide and secure the service.
  • Where CodeSignal assessments are used, additional data may be processed, such as assessment tasks and answers, scores, technical usage data, and, depending on the configuration, identity-verification and proctoring data. Some CodeSignal assessments may require candidates to share camera, microphone, screen, and a government-issued photo ID for identity verification and proctoring.

Please do not include special categories of personal data unless this is necessary for the application. Where such data is processed, this will only take place where legally permitted or based on your consent, where required.

Purposes and legal bases of processing

LEASETEQ processes your personal data for the following purposes:

  1. To review your application and carry out the recruitment process, including assessing your qualifications and communicating with you about the role. For roles in the EU/EEA, the legal basis is Art. 6(1)(b) GDPR and, where applicable, national employment-related provisions such as Section 26 BDSG in Germany. For Switzerland, processing is carried out in accordance with the FADP for the recruitment process.
  2. To maintain the security and functionality of the recruitment portal and related systems. For EU/EEA roles, the legal basis is Art. 6(1)(f) GDPR. For Switzerland, processing is based on LEASETEQ’s legitimate private interests and the applicable FADP framework.
  3. To establish, exercise, or defend legal claims arising from the application process. For EU/EEA roles, the legal basis is Art. 6(1)(f) GDPR and applicable national law. For Switzerland, the processing is based on LEASETEQ’s overriding private interests under the FADP framework.
  4. To include your profile in LEASETEQ’s talent pool and consider you for future suitable positions, where you have given your consent. For EU/EEA roles, the legal basis is Art. 6(1)(a) GDPR and, where applicable, Art. 9(2)(a) GDPR. For Switzerland, the legal basis is your consent where required under the FADP. You may withdraw this consent at any time with effect for the future.
  5. LEASETEQ may use AI-supported tools to review neutralized / redacted applicant profiles and to design, test, or improve internal recruitment workflows and related operational processes. These tools are used only on redacted profiles that are processed in a way intended to prevent direct identification of applicants, and only for internal efficiency, quality assurance, and process improvement purposes. LEASETEQ does not use such AI tools to make fully automated decisions that produce legal effects or similarly significant effects on applicants. Hiring decisions are made by human decision-makers.
  6. LEASETEQ may use the external assessment platform CodeSignal to support candidate evaluation for selected positions, in particular for technical and other specialist roles, including certified assessments relating to technical and professional skills, problem-solving ability, and selected aspects of collaboration or working style. Depending on the role, candidates may be invited to complete one or more CodeSignal assessments. For those selected positions (in particular technical roles) where CodeSignal assessments are used, additional data may be processed by CodeSignal on LEASETEQ’s behalf, such as assessment tasks and answers, scores, technical usage data, and, depending on the configuration, identity-verification and proctoring data.
  7. Before using CodeSignal, candidates are informed about the relevant processing and must actively declare their consent to the use of CodeSignal and to the processing of their personal data for this purpose. Without such consent, the CodeSignal assessment will not be carried out. For roles in the EU/EEA, the legal basis is Art. 6(1)(a) GDPR and, where applicable, Art. 9(2)(a) GDPR. For Switzerland, processing is based on the candidate’s consent under the FADP. Candidates may withdraw their consent at any time with effect for the future; this does not affect the lawfulness of processing carried out before withdrawal.

Obligation to provide data

You are not legally or contractually obliged to provide your personal data. However, without the information required for the application process, LEASETEQ may be unable to process or consider your application.

Recipients and processors

Your data will only be accessed by those employees and departments who need it for the application process, in particular HR, hiring managers, and relevant internal decision-makers. Access is granted on a need-to-know basis.

LEASETEQ uses Personio as applicant tracking and recruiting software provider. In this context, Personio acts as a processor for operation of the recruiting software and careers page on behalf of the respective controller. Public Personio career-site notices identify the provider as Personio SE & Co. KG, Seidlstraße 3, 80335 Munich, Germany.

LEASETEQ also uses CodeSignal as an external assessment provider for certain roles. CodeSignal processes candidate data for the agreed assessment purposes and should be covered by appropriate contractual safeguards, including a data processing agreement where required.

LEASETEQ may also engage other carefully selected service providers, such as IT, hosting, or support providers, where necessary for the recruitment process. Personal data may also be disclosed where LEASETEQ is under a legal obligation to do so.

International transfers

If personal data is transferred outside Switzerland, the EU, or the EEA, LEASETEQ will ensure that appropriate safeguards are in place, such as adequacy decisions, standard contractual clauses, or other legally recognised transfer mechanisms, as required by applicable law.

Retention periods

If your application is unsuccessful, LEASETEQ will generally retain your application data for up to six months after completion of the application process in order to respond to questions relating to the recruitment process and to establish, exercise, or defend legal claims.

If you consent to inclusion in the talent pool, LEASETEQ will retain your data for that purpose for up to 12 months after the end of the relevant application process, unless you withdraw your consent earlier.

If your application is successful and you enter into an employment relationship with LEASETEQ, your application data may be transferred to your personnel file and retained for the duration of the employment relationship and thereafter in accordance with applicable employee-data retention requirements.

Where retention is required by law or necessary to establish, exercise, or defend legal claims, LEASETEQ may retain relevant data for longer to the extent permitted by applicable law. After expiry of the applicable retention period, the data will be deleted, anonymised, or retained only in a form that no longer permits identification where permitted by law.

Your rights

Depending on the applicable law and the circumstances of the individual case, you have the following rights with respect to your personal data:

  • Right of access.
  • Right to rectification of inaccurate or incomplete data.
  • Right to erasure, subject to legal limitations.
  • Right to restriction of processing, where applicable.
  • Right to data portability, where applicable.
  • Right to object to processing based on legitimate interests, for reasons arising from your particular situation.
  • Right to withdraw consent at any time with effect for the future, where processing is based on consent.

Right to lodge a complaint

If you believe that the processing of your personal data violates applicable data protection law, you have the right to lodge a complaint with the competent supervisory authority. For Switzerland, this is generally the Federal Data Protection and Information Commissioner. For Germany and Austria, you may lodge a complaint with the supervisory authority at your place of residence, place of work, or the place of the alleged infringement.

No automated decision-making

LEASETEQ does not make decisions about your application based solely on automated processing, including profiling, that produce legal effects concerning you or similarly significantly affect you. Recruitment decisions are made by human reviewers.

Changes to this privacy notice

LEASETEQ may amend this privacy notice from time to time to ensure ongoing compliance with legal requirements and to reflect changes in the recruitment process or the technologies used. The version current at the time of your application or visit to the careers page shall apply.

Processing of (personal) data by the operator of the recruitment website

General information

This recruitment website is operated by Personio SE & Co. KG, which offers a human resource and candidate management software solution (https://www.personio.com/legal-notice/). Data transmitted as part of your application will be transferred using TLS encryption and stored in a database. The sole controller of this data within the meaning of article 24 of the GDPR is the enterprise carrying out this online application process. Personio’s role is limited to operating the software and this recruitment website and, in this context, being a processor under article 28 of the GDPR. In this case, the processing by Personio is based on an agreement for the processing of orders between the controller and Personio. In addition, Personio SE & Co. KG processes further data, some of which may be personal data, to provide its services, in particular for operating this recruitment website. We will refer to this in more detail below.

Access logs (“server logs”)

Each access to this recruitment website automatically causes general protocol data, so-called server logs, to be collected. As a rule, this data is a pseudonym and thus does not allow for inferences about the identity of an individual. Without this data, it would, in some cases, be technically impossible to deliver or display the contents of the software. In addition, processing this data is absolutely necessary under security aspects, in particular for access, input, transfer, and storage control. Furthermore, this anonymous information can be used for statistical purposes and for optimizing services and technology. In addition, the log files can be checked and analyzed retrospectively when unlawful use of the software is suspected. The legal basis for this is §25 subsection 2 Sentence 2 TDDDG. Generally, data such as the domain name of the website, the web browser and web-browser version, the operating system, the IP address, as well as the timestamp of the access to the software is collected. The scope of this log process does not exceed the common log scope of any other site on the web. These access logs are stored for a period of up to 7 days. There is no right to object to this.

Error logs

So-called error logs are generated for the purpose of identifying and fixing bugs. This is absolutely necessary to ensure we can react as quickly as possible to possible problems with displaying and implementing content (legitimate interest). As a rule, this data is a pseudonym and thus does not allow for inferences about the identity of an individual. The legal basis for this is §25 subsection 2 Sentence 2 TDDDG. When an error message occurs, general data such as the domain name of the website, the web browser and web-browser version, the operating system, the IP address, as well as the timestamp upon occurrence of the respective error message and/or specification is collected. These error logs are stored for a period of up to 7 days. There is no right to object to this.

Use of cookies

So-called cookies are used on parts of this recruitment website. They are small text files which are stored on the device with which you access this recruitment website. As a general rule, cookies serve the purpose of ensuring secure access to a website (“absolutely necessary”), implementing certain functionalities such as standard-language settings (“functional”), improving the user experience or the performance of the website (“performance”), or placing targeted advertisements (“marketing”). On this recruitment website, we generally use only cookies that are absolutely necessary, functional or performance-related, in particular for implementing certain default settings such as language, for identifying the job advertising channel, or for analyzing the performance of a job advert via which a user accessed this recruitment website. The use of cookies is absolutely necessary for providing our services and thus for the performance of the contract (article 6 (1) b) of the GDPR). Rights of data subjects

If Personio SE & Co. KG as the controller processes personal data, you as the data subject have certain rights under Chapter III of the EU General Data Protection Regulation (GDPR), depending on the legal basis and the purpose of the processing, in particular the right of access (article 15 of the GDPR) and the rights to rectification (article 16 of the GDPR), erasure (article 17 of the GDPR), restriction of processing (article 18 of the GDPR), and data portability (article 20 of the GDPR), as well as the right to object (article 21 of the GDPR). If the personal data is processed with your consent, you have the right to withdraw this consent under article 7 III of the GDPR. To assert your rights as a data subject in relation to the data processed for the purpose of operating this recruitment website, please refer to Personio SE & Co. KG’s Data Protection Officer (see item B).

Concluding provisions

Personio reserves the right to adjust this data privacy statement at any point in time to ensure that it is in line with the current legal requirements at all times, or in order to accommodate changes in the services offered, for example when new services are introduced. In this case, the new data privacy statement applies to any later visit of this recruitment website or any later job application.
